This scheme, which came into force on February 11, 1994, improves social protection for non-salaried workers who earn non-commercial profits (BNC) or industrial and commercial profits (BIC), and who have to pay their own healthcare costs.
Thanks to the Madelin law, self-employed workers benefit from an attractive tax advantage: they can deduct their mutual insurance contributions from their taxable income, up to the tax deduction ceiling. This ceiling is determined on the basis of the annual social security ceiling (PASS) and their professional income.
Apart from mutual insurers, the following contracts are eligible for this scheme:
– provident insurance contracts (sick leave, disability, etc.);
– retirement savings contracts;
– unemployment cover in the event of job loss.
This tax advantage is reserved for non-salaried workers, such as directors of EURLs, EIRLs, majority managers of SARLs or SASs, and partners and chairmen of SASUs.
If you’re a freelance auto-entrepreneur or agricultural self-employed worker, you can’t deduct your contributions from your taxable income, because you’re not covered by the actual tax system. As a freelance auto-entrepreneur or agricultural self-employed person, you already benefit from a flat-rate deduction from your sales. In other words, your expenses are already factored in by the tax authorities.
